Understanding the restricted zone and fideicomisos Entendiendo la zona restringida y los fideicomisos

Mexico encourages foreign investment, but the Constitution restricts direct ownership in the “restricted zone” — 50 km from the coast and 100 km from the borders. In these areas, foreign buyers typically hold property through a fideicomiso (bank trust) or a Mexican entity. The security of your investment depends less on the concept and more on how the legal structure, notarial work and registrations are executed. México fomenta la inversión extranjera, pero la Constitución limita la propiedad directa en la “zona restringida” — 50 km de las costas y 100 km de las fronteras. En esas áreas, los compradores extranjeros suelen tener inmuebles mediante un fideicomiso bancario o una entidad mexicana. La seguridad de tu inversión depende menos del concepto y más de cómo se ejecutan la estructura legal, el trabajo notarial y los registros.

  • A fideicomiso is a bank trust: the bank holds legal title, you are the beneficiary with the right to use, build, lease, finance, sell and name heirs. Un fideicomiso es un contrato con un banco: la institución tiene el título legal, tú eres el beneficiario con derecho a usar, construir, rentar, financiar, vender y designar herederos.
  • Terms are usually 50 years and renewable; the real protection lies in correct drafting, notarization and registration. Los plazos suelen ser de 50 años y renovables; la verdadera protección está en la correcta redacción, formalización notarial y registro.
  • Title, Catastro (tax) records and physical boundaries must all match to avoid future disputes or financing issues. El título, el registro catastral y la realidad física deben coincidir para evitar conflictos o problemas de financiamiento.
