Tantum Companies includes, without limitation, Tantum Developers, Tantum LLC (dba Tantum Marketing), Tantum Materials, Tantum SA de CV, and any future affiliates or subsidiaries under the Tantum brand (collectively, the “Tantum Group”). We operate primarily in Texas, United States, and in Mexico.

6. Referral & Marketing Compensation (Transparency)

Tantum may receive referral fees or marketing/advertising compensation for introductions to certain independent third parties. We limit such arrangements to categories that, in our experience, generally permit marketing/referral compensation (subject to applicable law), such as:

  • general contractors and construction trades (where permitted);
  • architects/engineers/surveyors and similar technical providers (where permitted);
  • building materials, equipment, or technology vendors;
  • marketing, software, and general business service providers.

Excluded / restricted categories: We do not accept or pay referral compensation for Texas real estate brokerage activity in a manner that would require licensing or violate TREC/TRELA rules, and we do not accept referral payments from insurance companies for insurance placement. We also avoid referral-fee arrangements in settlement-service contexts where federal/state restrictions may apply, unless expressly permitted by law with appropriate disclosures.

Where required or appropriate, we disclose material referral/marketing relationships in context (for example, near a recommendation). You are under no obligation to use any provider we introduce.

7. International Data Transfers

Because we operate in the United States and Mexico and may use global service providers, your information may be processed in multiple jurisdictions. We take reasonable steps to protect personal information consistent with this Policy and applicable law.

8. Data Retention

We retain personal information as long as reasonably necessary for the purposes described, including compliance, dispute resolution, and enforcement.

9. Data Security

We implement reasonable safeguards, but no internet transmission or storage is completely secure; absolute security cannot be guaranteed.

These Terms & Conditions (“Terms”) govern your access to and use of Tantum’s websites, content, forms, and related services (the “Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. Consulting/Advisory Only; No Brokerage by Tantum

Tantum provides consulting/advisory and coordination services. Tantum Companies is not a Texas-licensed real estate brokerage and may not list, sell, negotiate, or transact real estate.

Texas real estate disclosure: All Texas real estate brokerage services and Texas property listings referenced on this site are provided by Coldwell Banker D’Ann Harper, REALTORS® (“CBDHR”), a Texas-licensed real estate brokerage.

3. No Legal/Tax/Accounting Advice; No Attorney–Client Relationship

Tantum is not a law firm and does not provide legal services. Tantum is not a CPA firm and does not provide accounting services. Nothing on the Services constitutes legal, tax, accounting, financial, investment, or other regulated professional advice. Use of the Services does not create an attorney–client relationship.

4. Third-Party Providers; No Endorsement; No Liability

Tantum may introduce you to or share information about independent third parties (e.g., contractors, consultants, vendors, lenders, attorneys, accountants) (“Third-Party Providers”). Third-Party Providers are independent and are not employees, partners, joint venturers, or agents of Tantum.

Any introduction is for convenience and does not constitute an endorsement, certification, or warranty unless expressly stated in writing. You are solely responsible for due diligence (including licensing, credentials, insurance, pricing, and suitability) and for contracting directly with any Third-Party Provider.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TANTUM SHALL HAVE NO LIABILITY for any Third-Party Provider’s acts or omissions, advice, services, pricing, performance, representations, compliance, or outcomes. Any engagement is solely between you and the Third-Party Provider.

6. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TANTUM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TANTUM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO THE SERVICES OR ANY THIRD-PARTY PROVIDER.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TANTUM’S TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TANTUM FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE SIX (6) MONTHS BEFORE THE EVENT OR (B) $100.

8. Indemnification

You agree to defend, indemnify, and hold harmless Tantum and its affiliates, owners, officers, directors, employees, and contractors from and against any claims, liabilities, damages, judgments, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Services, violation of these Terms, or engagement with any Third-Party Provider.

9. Governing Law; Venue

These Terms are governed by Texas law. Exclusive venue for disputes shall be in state or federal courts located in Texas, and you consent to jurisdiction there (unless a separate written engagement agreement contains an arbitration clause).
